Le tout-puissant promoteur immobilier de la capitale, Kamel Chikhi, ainsi que ses deux frères ont été placés sous mandat de dépôt par le juge du pôle pénal spécialisé d’Alger, dans le cadre de l’affaire des 701 kg de cocaïne saisis à Oran. C’est à l’aube de la journée d’hier que le juge de la 9e chambre du pôle pénal spécialisé d’Alger a achevé les auditions marathoniennes d’une trentaine de personnes, liées de près ou de loin à l’affaire des 701 kg de cocaïne saisis au port d’Oran, dissimulés dans une cargaison de viande congelée importée du Brésil et ayant transité par l’Espagne. Les derniers à avoir été entendus durant plus de 12 heures sont Kamel Chikhi, le puissant promoteur immobilier, importateur de viande congelée, et ses deux frères. Les trois hommes ont été inculpés et placés sous mandat de dépôt pour les mêmes chefs d’inculpation retenus la veille contre trois autres personnes — le directeur commercial d’une des sociétés de Kamel Chikhi, un de ses agents et un de ses associés —, à savoir : «constitution d’organisation pour l’importation, le commerce et la distribution de drogue» ainsi que pour «blanchiment d'argent». Le juge a remis en liberté les six Philippins membres d’équipage du navire Vega Mercury, affrété par la compagnie suisse MSC (dont les propriétaires sont italiens) pour le compte de l’importateur algérien, et maintenu les 25 autres personnes avec le statut de témoins en attendant la fin de l’instruction. Exténués par près de 48 heures d’audition sans interruption, le collectif d’avocats des mis en cause a décidé d’interjeter appel dès demain contre les six mandats de dépôt et de plaider, auprès de la chambre d’accusation, la liberté. C’est ce que nous a confié, hier, Me Saddek Chaib, membre du collectif de défense, dans une déclaration à chaud. L’avocat espère que «l’instruction soit poussée le plus loin possible», parce qu’il «est vraiment naïf de croire que cette importante quantité de cocaïne soit l’affaire des six prévenus. Nous allons demander des commissions rogatoires au Brésil, pour savoir ce qui s’est passé à l’embarquement de la marchandise, mais aussi à l’Espagne pour comprendre ce qui s’est passé au port de Valence et qu’est-ce qui a poussé les autorités espagnoles à laisser partir le navire sachant qu’il y avait de la drogue à l’intérieur. Ce sont des questions qui méritent réponse pour la manifestation de la vérité». Me Chaib précise, par ailleurs, qu’avec ses confrères du collectif, il doit se «concerter autour de la nécessité ou non d’informer l’opinion publique, par communiqué ou conférence de presse, des tenants et des aboutissants de ce dossier», en mettant l’accent sur le fait que «les prévenus bénéficient de la présomption d’innocence tant qu’ils n’ont pas été jugés et condamnés définitivement». Pour l’instant, rien n’a filtré du contenu des auditions, mais il y a des interrogations assez pertinentes qui méritent réponse. D’abord l’absence, parmi les personnes convoquées, du représentant de la compagnie MSC, qui s’est chargée de ramener la marchandise du port de Valence en Espagne vers le port d’Oran, après son transbordement à bord du navire Vega Mercury qu’elle a affrété. Mais aussi celle du représentant du fournisseur brésilien, auprès duquel la viande congelée a été achetée et qui avait embarqué celle-ci, à partir du Brésil, à destination de l’Espagne, puis de l’Algérie. Les plus avertis s’intéressent particulièrement aux scellés des conteneurs et se demandent s’ils ont été changés au cours du transport et, dans ce cas-là, le transporteur a une grande responsabilité dans l’affaire et, dans le cas contraire, c’est au fournisseur de s’expliquer. Autant de détails que le juge de la 9e chambre du pôle pénal spécialisé va tenter d’élucider avec l’aide des commissions rogatoires. Pour l’instant, l’affaire n’est qu’à son début et rien n’indique que d’autres éléments plus importants apparaissent dans les jours à venir. En tout état de cause, personne ne croit, y compris les avocats des mis en cause, que cette opération d’importation de 701 kg de cocaïne s’arrête aux six prévenus en détention à la prison d’El Harrach. La justice se trouve ainsi devant un défi, celui de ne pas se limiter au menu fretin.
