Dans cet entretien, Wissam Meziane, enseignant d’architecture à l’université Constantine 3, et expert des questions juridiques liées à l’urbanisme, explique les raisons historiques de ce conflit, qui vient de rebondir, sur la forme d’exercice de la profession d’architecte en Algérie. - Des architectes se rebiffent de manière récurrente pour l’autorisation des Sarl et Eurl à exercer le métier d’architecte… Oui, ce sont toujours les architectes qui posent ce problème, contrairement aux autres professions libérales comme les avocats, les médecins, les notaires, qui pratiquent dans des cabinets portant leurs noms. Et cela s’explique par l’héritage. Le modèle actuel d’exercice de l’architecture en Algérie est hérité du temps des bureaux d’études publics. En 1966, la profession pratiquée jusqu’alors de manière libérale a été étatisée, d’abord dans des bureaux d’études intégrés dans des entreprises. Ce n’est qu’à partir de 1984, dans le cadre de la restructuration des entreprises, que ces bureaux sont devenus des entités autonomes, mais toujours propriété de l’Etat. Ils vont exercer sous la forme d’EPE (entreprise publique économique, ndlr) avec l’introduction du code BET dans le registre du commerce, auquel sont désormais soumis ces bureaux. Parallèlement, un notaire qui s’adresse au registre du commerce est renvoyé pour absence de code. L’héritage est double : institutionnel et réglementaire. Cet héritage des BET persiste. Et ça se voit dans les dénominations. Vous ne trouverez pas un cabinet d’avocat qui ne porte pas les nom et prénom de son fondateur. Par contre, vous avez partout des cabinets d’architectes où le nom de la personne physique est remplacé par des appellations commerciales. Dans la mentalité de ces derniers, la profession s’exerce dans un bureau d’études, c’est une perception de soi polluée, et certains trouvent donc naturel d’exercer dans le cadre de Sarl ou de Eurl. Ils ne se présentent pas en tant qu’architectes agréés, mais en tant que directeurs de bureau d’études ! - Ce brouillage n’a jamais été levé ni par le ministère de tutelle, ni par l’Ordre des architectes, ni par l’université… L’université n’a rien à voir, a fortiori, elle se contente depuis 2008 d’enseigner la science, elle ne forme plus de professionnels en vertu de la loi sur le LMD. Ça aussi il faut le dire parce que les gens ont toujours l’idée que l’université forme des architectes. Non, l’université enseigne l’architecture et sanctionne l’enseignement par un diplôme non pas d’architecte, mais de master en architecture. Pour répondre à votre question, oui le brouillage n’a toujours pas été levé parce que quelque part on refuse de le faire. - Que pensez-vous de la réponse de l’actuel ministre sur cette question ? A mon sens, le ministre n’a pas voulu se contenter d’apporter une réponse juridique strictement limitée au droit positif algérien, il a préféré apporter une réponse prospective. En ce sens que, objectivement, rien ne s’opposerait à ce que l’exercice de la profession d’architecte puisse évoluer vers la forme commerciale. C’est une réponse conforme à son statut de ministre qui, en tant que membre de l’Exécutif, a la prérogative de proposer des lois, ce n’est pas la réponse d’un juge. Parce que du point de vue strictement juridique, les choses sont claires : la profession d’architecte est une profession libérale et ne peut s’exercer dans le cadre commercial et cela a toujours été la position de l’Ordre des architectes et du ministère chargé de l’architecture depuis plus de 20 ans. Toutefois, un cadre commercial spécifique devra être défini de façon à permettre le développement de la profession et l’émergence de la qualité architecturale. Sinon où serait l’intérêt ? - Quels sont les enjeux ? La raison est simple, en fait, les bureaux d’études techniques publics, comme BERG, Berep, Ceneac, Bneder, ou encore BEM, existaient avant la loi 94/07. Ce sont des bureaux immenses, structurés en EPE, qui ne peuvent pas être supprimés du jour au lendemain. Si on revient à la norme, ils n’ont plus le droit de faire de l’architecture. Il y a un conflit, mais ce n’est pas de leur faute si aucune disposition n’a été prise, y compris de la part du CNOA, pour résoudre leur cas, au moment de la promulgation de la nouvelle loi. Aujourd’hui, une solution est possible considérant qu’ils ont existé avant, et compte tenu de l’immense capital expérience de ces bureaux, leur pluridisciplinarité et leur rôle dans la formation. Il faut juste établir une disposition transitoire en agréant les architectes employés au sein de ces bureaux, qui vont signer de leurs noms comme le font les médecins dans les hôpitaux. Au lieu de les couler et mettre les gens au chômage, on peut résoudre la problématique intelligemment et mettre fin à la cassure avec les orthodoxes de la pratique libérale «l’architecture aux architectes» et l’exclusion des BET. Et donc, comme on ne pouvait pas dissoudre ces BET, le code a été maintenu au registre du commerce, mais les pressions exercées par l’Ordre des architectes ont fait que le CNRC exige du BET l’agrément avant de lui délivrer le registre du commerce. - Pour quelle raison des architectes choisissent la forme commerciale au lieu de fonder un cabinet ? Les formes commerciales Sarl et Eurl offrent des avantages (fiscaux, obtention de crédit…). Prenons l’exemple de quelques-uns des plus grands cabinets d’architecture et qui se trouvent à Constantine. Dembri ou Naceri par exemple sont des personnes physiques, en revanche Hafiane détient des Sarl parce qu’il a investi avec des crédits. Un architecte comme Naceri, par exemple, qui a réalisé les plans de la ville universitaire de Constantine avec un montant d’honoraires de 67 milliards de centimes, l’a fait en tant que personne physique. Pourquoi les autres trouvent alors des arguments pour exercer dans des Sarl ? La raison est simple : certains architectes oublient que l’architecture est un acte éminemment civilisé de création. Les œuvres majeures des grands architectes du XXe siècle, je cite Franck Lloyd Wright, Le Corbusier et Mies van der Rohe, sont de petites maisons individuelles : la Villa Savoye, la Villa sur la cascade et le Pavillon de Barcelone. Quand on fait de l’architecture pour l’architecture, on ne cherche pas des moyens, mais quand on veut faire de l’argent en faisant de l’architecture, c’est normal de choisir l’activité commerciale. Cela dit, la forme commerciale est intéressante sur au moins un aspect pour éviter à l’architecte de s’endetter, ce dernier n’étant payé pour la commande qu’au bout de six mois.
